1. Acceptance of Terms

By accessing or using PetWhats (“the Service”), operated by PetWhats (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to update or modify these Terms at any time. Material changes will be communicated via email (to the address associated with your account) or through a prominent notice on our website. Your continued use of the Service after any such changes constitutes acceptance of the updated Terms.

2. Description of Service

PetWhats provides a video-based pet behavior and emotion insight platform. Users upload short video clips of their pets, and the Service generates an analysis that includes behavioral observations, an emotion assessment, and general care suggestions (“Analysis Results”).

Important: The Analysis Results are produced by automated systems (including third-party machine-learning models) and are provided for informational and entertainment purposes only. They do not constitute veterinary diagnosis, medical advice, or professional animal behavior consultation. Always consult a licensed veterinarian for health or behavioral concerns regarding your pet.

3. Eligibility

You must be at least 16 years of age to create an account and use the Service. If you are between 16 and 18 (or the age of majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

By creating an account, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate, current, and complete.

4. User Accounts & Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You agree to notify us immediately of any unauthorized use of your account or any other breach of security at [email protected].
  • You may not use another user's account without permission. Each account is for a single individual; sharing credentials is prohibited.
  • We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent or abusive activity, without prior notice.

5. Acceptable Use Policy

You agree not to use the Service to:

  • Upload, transmit, or distribute any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, invasive of another's privacy, or otherwise objectionable.
  • Upload videos depicting animal cruelty, abuse, neglect, or any activity that harms or exploits animals in any way.
  • Upload videos containing illegal content, sexually explicit material, hate speech, or content that promotes violence against any person or group.
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Interfere with or disrupt the Service, its servers, or networks connected to the Service, or disobey any requirements, procedures, policies, or regulations of networks connected to the Service.
  • Attempt to gain unauthorized access to any part of the Service, other accounts, computer systems, or networks through hacking, password mining, or any other means.
  • Use any automated means (bots, scrapers, crawlers) to access or collect data from the Service without our express written permission.
  • Reverse-engineer, decompile, disassemble, or attempt to extract the source code of the Service, except as expressly permitted by applicable law.
  • Use the Service for any commercial purpose not authorized by us, including reselling access, white-labeling results, or embedding the Service in another product.

6. Intellectual Property Rights

6.1 Our IP

The Service, including its website, branding, logos, design, software, algorithms, text, graphics, and all other content (excluding User Content as defined below), is owned by or licensed to PetWhats and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

6.2 Your Content

You retain all ownership rights to the videos, pet profile information, and other content you upload or submit to the Service (“User Content”). By submitting User Content, you grant PetWhats a worldwide, non-exclusive, royalty-free license to use, reproduce, process, store, and display your User Content solely for the purpose of providing and improving the Service to you.

6.3 Analysis Results

The Analysis Results generated from your User Content are provided for your personal, non-commercial use. You may share them on social media or with your veterinarian. You may not sell, license, or distribute Analysis Results as a standalone product or as part of any commercial offering.

7. User Content Warranties

By uploading User Content, you represent and warrant that:

  • You own or have obtained all necessary rights, licenses, and permissions to the content.
  • The content does not infringe any third party's intellectual property, privacy, or publicity rights.
  • The content complies with all applicable laws and these Terms.

We do not pre-screen User Content, but we reserve the right (without obligation) to review, flag, and remove any content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable. We may report illegal content to the appropriate authorities.

8. Payments, Subscriptions & Billing

8.1 Free Tier

PetWhats offers a free tier with limited daily uploads. Free-tier limits are subject to change with reasonable notice. The current limits are published on our pricing page.

8.2 Premium Subscription

Premium subscriptions provide increased upload limits and additional features as described on our pricing page at the time of purchase. Subscriptions are billed in advance on a recurring monthly basis through our third-party payment processor (currently PayPal).

8.3 Automatic Renewal

Unless you cancel before the end of the current billing period, your subscription will automatically renew for an equivalent period at the then-current price. You authorize us (through our payment processor) to charge your payment method for each renewal period.

8.4 Price Changes

We may change subscription fees at any time. Price changes will take effect at the start of the next billing cycle following notice to you. If you do not agree with the price change, you may cancel your subscription before the change takes effect.

8.5 Payment Processing

All payments are processed by PayPal. You are subject to PayPal's terms of service and privacy policy in addition to these Terms. We do not store your full payment card details on our servers.

9. Refunds & Cancellation

9.1 Cancellation

You may cancel your subscription at any time through your account Settings page. Cancellation takes effect at the end of your current billing period — you will retain premium access until that date. There are no long-term contracts, and no cancellation fees.

9.2 Refunds

Subscription payments are generally non-refundable. However, we will consider refund requests on a case-by-case basis if:

  • You were charged in error (e.g., duplicate charge).
  • The Service was materially unavailable during your subscription period.
  • You request a refund within 48 hours of the initial charge or renewal.

To request a refund, contact us at [email protected] with your account email and the transaction details. Refunds, if granted, will be issued to the original payment method.

10. Third-Party Services

The Service integrates with third-party providers to deliver core functionality. By using the Service, you acknowledge that your data may be processed by these providers as necessary:

  • AI Analysis Provider (Google Gemini / alternative) — Video content is transmitted to a cloud-based AI service for behavioral analysis. You agree to such transmission as a necessary part of the Service.
  • Cloudflare R2 — Uploaded videos are stored on Cloudflare's edge storage network for delivery and processing.
  • Resend — Transactional emails (verification, notifications) are sent through Resend's email API.
  • PayPal — Payment processing, subscription management, and billing are handled by PayPal.

We are not responsible for the practices, content, or availability of third-party services. Your use of these services may be subject to their respective terms and privacy policies.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

Without limiting the foregoing, we do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free.
  • The Analysis Results will be accurate, complete, or reliable.
  • Any errors or defects in the Service will be corrected.
  • The Service is free of viruses or other harmful components.

Analysis Results are generated by automated systems. Emotions are complex and multi-faceted — no automated system can capture them with complete accuracy. Do not rely on Analysis Results for decisions that could affect your pet's health or safety.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PETWHATS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, use, or goodwill.
  • Damages resulting from reliance on Analysis Results.
  • Harm or injury to any pet resulting from actions taken (or not taken) based on Analysis Results.
  • Service interruption or data loss from any cause.
  • Unauthorized access to or alteration of your transmissions or data.

In no event shall our aggregate liability for all claims relating to the Service exceed the greater of (a) the total amount paid by you to PetWhats during the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars (USD $100). Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless PetWhats and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of and access to the Service.
  • Your violation of any term of these Terms.
  • Your violation of any third-party right, including any copyright, property, or privacy right.
  • Any claim that your User Content caused damage to a third party.

14. Data Protection & Privacy

Your privacy is important to us. Our collection, use, and disclosure of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. For users in the European Economic Area (EEA), United Kingdom, and Switzerland, we process personal data in accordance with the General Data Protection Regulation (GDPR) and applicable local laws.

You may exercise your data subject rights (access, rectification, erasure, portability, objection, and restriction) at any time through your account settings or by contacting [email protected].

15. Termination

By You: You may terminate your account at any time through the Settings page. Upon termination, your right to access the Service will cease immediately. Your User Content will be scheduled for deletion in accordance with our data retention policy (see Privacy Policy).

By Us: We may terminate or suspend your account and access to the Service, with or without cause, with or without notice, effective immediately. Grounds for termination include but are not limited to: violation of these Terms, fraudulent activity, abusive behavior, extended inactivity, or requests by law enforcement.

Upon termination, all provisions of these Terms that by their nature should survive shall survive, including but not limited to intellectual property rights, disclaimers, limitations of liability, and indemnification.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. When we do, we will update the “Last updated” date at the top of this page and notify you via email or through a notice on the Service. Material changes will be communicated at least fourteen (14) days before they take effect.

By continuing to access or use the Service after the effective date of revised Terms, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Service and may terminate your account.

17. Governing Law & Dispute Resolution

17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. For users in the EEA, United Kingdom, or Switzerland, mandatory consumer protection laws of your country of residence shall also apply and these Terms do not restrict those rights.

17.2 Informal Resolution

Before filing a formal legal claim, you agree to first contact us at [email protected] and attempt to resolve the dispute informally. We will make reasonable efforts to resolve any dispute within sixty (60) days.

17.3 Arbitration

Any dispute not resolved through informal negotiation shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. Arbitration shall take place in Delaware, United States, or via video conference at your preference. You may also bring claims in small claims court if they qualify instead of arbitration. You agree to bring claims only in your individual capacity and waive any right to participate in a class action or class-wide arbitration.

17.4 EU/UK Consumer Rights

If you are a consumer residing in the EEA, United Kingdom, or Switzerland, nothing in this section limits your right to bring proceedings in the courts of your country of residence, or your right to rely on mandatory provisions of local consumer protection law.

18. Copyright Infringement (DMCA)

We respect the intellectual property rights of others. If you believe that any content available on or through the Service infringes your copyright, please send a notification to [email protected] containing:

  • A physical or electronic signature of the copyright owner or authorized agent.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing, including information sufficient to locate it on the Service.
  • Your contact information (address, phone number, email).
  • A statement that you have a good-faith belief the use is not authorized.
  • A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

19. General Provisions

19.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PetWhats concerning the Service and supersede all prior agreements and understandings.

19.2 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of PetWhats.

19.4 Assignment

You may not assign or transfer these Terms, or any rights or obligations hereunder, without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

19.5 Force Majeure

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government actions, internet or infrastructure failures, and third-party service outages.
